Joanne’s Driving School Ltd – Terms & Conditions
1. Payment will be due in blocks of 7.5 hours (5 x 2 hour lessons), additional block payments will become due the final week of the previous block of lessons to reserve the lesson slot.
2. Joanne’s Driving School Ltd (the Company) and its Instructor’s (acting on behalf of the Company) reserve the right to change the hourly rate at any time for new bookings. They will ensure they provide reasonable prior notification to the Pupil.
3. Cash or bank transfer only, no cheques.
4. Payment for sitting a practical driving test is paid directly to the DVSA, however this does not include the use of a tuition vehicle. Therefore, a payment must be made to the Instructor (acting on behalf of the Company) directly for use of the vehicle and time spent travelling to and from the test centre.
5. The Pupil certifies that a valid suitable Driving Licence is held to drive the tuition vehicle. Pupils must inform their Instructor (acting on behalf of the Company) immediately if they receive any indorsements on their Driving Licence during the period they are receiving tuition. The Pupil must be able to pass the DVSA eyesight check before driving.
6. In the event of mechanical breakdown or other difficulty outside the control of the Instructor, the Instructor reserves the right to rearrange lessons at short notice.
7. A minimum of 48 hours’ notice is required to be given to the Instructor by the Pupil to cancel a Driving Lesson. Should the Pupil fail to give notice the Pupil is liable to pay the full Driving Lesson fee.
8. Block bookings are non-refundable once commenced. Any unused lessons may be refunded at the Company’s discretion.
9. Block bookings must be used within 3 months of purchase.
10. If the pupil is late, the lesson will still end at the agreed time and full payment remains due.
11. If the instructor cancels a lesson, an alternative lesson will be offered.
12. The lesson duration is pre-agreed between the Instructor and the Pupil – typically one and a half hours. If for any reason, outside the Instructor’s control, it is not possible to deliver the full lesson duration, any remaining time will be added to the later Driving Lesson.
13. LEGAL LIABILITY. The Instructor's primary objective is to promote road safety and in doing so, he/she may take control of the vehicle. The Instructor cannot be held liable for any errors that the Pupil may make whilst driving and not accompanied by the Instructor.
14. The Instructor will endeavour to teach the Pupil the correct driving skill according to the recommended syllabus issued by the DVSA.
15. Driving Tests may only be arranged with the prior agreement of both the Instructor and Pupil.
16. Any complaints are to be dealt with in accordance with the ADI code of practice.
17. The Instructor is at liberty to refuse to proceed with a lesson if they believe that a Pupil is in anyway under the influence of drink or drugs.
18. The instructor reserves the right to terminate a lesson if the Pupil behaves in a manner deemed unsafe, abusive or inappropriate. No refund will be given.
19. Nothing in these terms and conditions excludes liability for death or personal injury caused by negligence.
20. Personal data will be processed in accordance with UK GDPR and our Privacy Policy, available at Joanne’sdrivingschool.co.uk.
21. If the Pupil agrees, the Instructor may take photographs/videos of the Pupil after their Driving Test for social media/reviews.
22. The Instructor reserves the right to withhold the use of his/her vehicle for a Driving Test.
23. Nothing in these Terms and Conditions will affect any statutory rights the Pupil may have as a consumer.
24. All contracts for driving tuition are made between the pupil and Joanne’s Driving School Ltd.
25. Joanne’s Driving School reserves the right to change and amend these Terms and Conditions at any time without prior notice.
